New exec orders to expand opportunities for VOBs

Good news for veteran owned businesses and organizations like VOB108- via Army Times:

The Obama administration is renewing efforts to expand opportunities for veteran-owned small businesses, hoping that a little aid to those who own or want to own their own businesses will help fuel a larger boost in the U.S. economy.

Two executive orders signed Monday (Apr 26, 2010)by President Obama create task forces that will recommend specific improvements in how small businesses are created, including expanded access to capital, advice on how to cash in on lucrative federal contracts and better counseling so that businesses remain on a strong economic footing. One of the two task forces specifically will look at veteran-owned small businesses, including those owned by disabled veterans.

Veterans’ Affairs Secretary Eric Shinseki said veterans, especially those returning from Iraq and Afghanistan, have training and experience from the military that make them potentially strong small-businesses owners, including the ability to remain calm and innovative in a crisis, knowing how to take risks and knowing how to run a competent organization.

There are, he said, “significant opportunities for good outcomes” if the federal government can provide assistance.

Helping one veteran become a small-business owner has larger impacts on the economy, he said, because “veterans hire veterans. They know what they are getting.”

Now if we could only take the GSA and their incipient schedules out of the process for true small veteran owned businesses ($1 million and below) we may see some real action in the area. We made a proposal for a GSA Schedule EZ in 2005- that could also solve some of these problems.

The number one obstacle to gaining government work for small veteran owned businesses is the ordeal of getting and maintaining a GSA Schedule.

Big businesses winning contracts meant for small ones, groups charge

A new skirmish is emerging in an ugly, ongoing dispute between small business advocates and the federal government over its past — and perhaps continuing — practice of awarding small business contracts to Fortune 500 companies.

The American Small Business League in a lawsuit is accusing the General Services Administration of destroying information in a database that could help advocates trace the violations, and the league has asked a federal court in Northern California to force the government to restore the data, which spans 10 years, and to make the information public. A federal judge is set to decide on the request for a preliminary injunction by the end of April.

For years, the Petaluma, Calif.-based organization, which represents 100,000 businesses seeking federal contracts, has tried to hold the government accountable for federal regulations that require 23 percent of its contracts to be set aside for small businesses. The government has never met that goal, small business advocates say. Instead, many contracts have been awarded to companies such as Falls Church-based General Dynamics, Xerox and General Electric, advocates say, withholding billions of dollars annually from small businesses.

“I believe $10 billion a month in federal contracts that by law should be going to small businesses are actually going to Fortune 500 firms and to some of the biggest companies around the world,” said Lloyd Chapman, president of the ASBL.

“It’s devastating to small businesses,” Chapman said, adding that he’s talked with several that have closed because they couldn’t get contracts.

A spokeswoman for the GSA said her agency could not comment on the lawsuit.

At issue is whether large businesses deliberately defrauded the government and should be punished, as the advocates argue. The Small Business Administration denied that the contracts went to large companies intentionally. A spokesman said the awards resulted from a number of problems: companies mistakenly applying for contracts because they were unaware of the complex guidelines of what constitutes a small business; data entry errors; and agencies failing to update records after large companies, including General Dynamics, bought small businesses that earlier had received contracts.

“In nearly all the cases, it’s a data integrity issue, not awarding the contract falsely,” said SBA spokesman Jonathan Swain. “The integrity of this data is a top priority” for SBA Administrator Karen Mills.

The dispute centers on the government’s move last month to drop a field from its database that captured companies that identified themselves as small businesses. Advocates say they used that field to determine whether large companies had illegally misidentified themselves as small businesses to get the contracts. Companies that falsely represent themselves are subject to fines of up to $500,000 or a prison term of up to 10 years, though the government has rarely if ever imposed the penalties, advocates say.

A study issued by the SBA’s inspector general in February said 11 of 36 contracts it sampled were awarded to businesses reported “as small, but the contract file reflected that they were other than small.”

“We really don’t know how much business we’re looking at” that was lost, said Fred Valerino Sr., director and founder of Pevco, a 70-employee Baltimore company that sells pneumatic tubes, similar to the devices used in drive-through bank windows, that allow government hospitals to send items from one end of their building to another.

Valerino said government audits show that his competitor, a Swiss multinational corporation, received 147 sole-source contracts from the government that were destined for small businesses. “All we’re looking for is a fair share of the industry,” he added.

Last year, the SBA reported that the government had set a record in 2008 awarding federal contracts to small businesses. However, it said only 21.5 percent of the contracts went to these firms, still below the 23 percent requirement. Advocacy groups such as the National Association of Small Business Contractors said the shortfall represented $30 billion in lost revenue to the firms.

Swain of the SBA in part faulted an overwhelming crush of contracting transactions — 8 million — that government officials oversee each year. He said the government is training contracting officers to look for errors and increase quality control.

“We are periodically running anomaly reports to identify any contracts that are coded as having gone to a small business that might look questionable,” Swain said. “We’re sending those reports to the procurement officer in the agency that specifically awarded the contract to reconfirm the data.”

BTAS in Beavercreekwins $15M Air Force contract option

One of the things we have been discussing at VOB108 executive board meetings is how to build relationships with area prime contractors so that VOB108 can help them meet their sub-contracting goals.

BTAS in Beavercreek just won a major contract, according to the Dayton Business Journal:

One of the area’s largest defense contractors received a $15 million U.S. Air Force contract option on July 31.

Beavercreek-based BTAS Inc. will aid the U.S. Department of Defense by acquiring munitions, such as bombs and missiles. The contract is up for re-competition next year.

BTAS is a technology and business services company, specializing in information technology support services, financial management, and program management support to the federal marketplace. The company has more than 300 employees in 18 locations nationwide, including 106 locally. It posted $53.7 million in revenue last year.

The contract option is part of a $77 million contract awarded in 2005 through the Air Armament Center at Eglin Air Force Base, Fla., according to a contract specialist for the Technical and Acquisition Management Support at the base.

The center is responsible for the development, acquisition, testing, and deployment of all air-delivered weapons.

VetBiz news: tips and tricks to get assistance

You do not have to pay (much money) for general federal contracting advice and assistance.

We are seeing a rapid growth in consultants and other organizations selling federal contracting advisory services to veteran-owned small businesses. In some cases, a business owner may decide to utilize consultants or other services for a specific purpose. However, we would like to remind you that many advisory and assistance services are available for free, or at very low cost. For example,

The Procurement Technical Assistance Centers (www.aptac-us.org) give free advice and counseling to small business owners selling to federal customers.
The federal small business offices and small business specialists advise small business owners how to sell to their agency (www.osdbu.gov).

The federal small business directors (www.osdbu.gov) hold an annual conference in Upper Marlboro, MD to meet with small business owners and help them sell to their agencies. This year’s conference is April 24,
2008. The price is $100 before April 1. You can register on line at http://www.fbcinc.com/osdbu/registration.asp.
The General Services Administration gives free workshops on how to get a FSS Supply Schedule contract. GSA will teach you how to do it; you have to do all the work. You can find GSA events on the www.gsa.gov website.

There is currently no Federally-recognized certification of veteran status at the current time. Public Law 109-461 establishes a verification of registrants in the VetBiz VIP database. “Certifications” by third party
certifying organizations have no status in federal contracting.

Small Business Development Centers (www.asbdc-us.org) provide free business advice and counseling to small business owners.

Register for the Fourth Annual National Veterans Small Business Conference

There are specific requirements for Teams or Joint Ventures to be qualified as Service-Disabled-Veteran-Owned Small Business Concerns when responding to an SDVOSB set aside.

A general rule of thumb in all small business programs is that the small business must manage the contract and add value. VA and other federal customers are encountering an increasing number of “SDVOSB Teams” and
“SDVOSB Joint Ventures” in which the non veteran partners are in reality the lead partner, and the service-disabled veteran does not own and control the entity that will be the prime contractor. Several have been protested, and the awards overturned based on ownership and control.

When a service-disabled veteran partners with another small business to form an SDVOSB joint venture, the joint venture must fully comply with federal small business regulations, and the JV agreement must be approved by the contracting officer before award of the contract.

the Air Force Security Assistance Center (AFSAC) here at WPAFB. Mr. Koogler
